hibi - Terms of Service

Service: hibi, an AI memory companion mobile app and related sites/services ("Service")

By using the Service, you agree to these Terms. If you don't agree, do not use the Service.

1. What hibi is

hibi is an AI memory companion that chats with users and generates daily and weekly memory entries. The Service is provided as-is and may evolve over time.

2. Who can use hibi (Eligibility)

You must be 13 or older to use the Service. If your local law requires a higher age to consent to online services, you must meet that age or use the Service with a parent/guardian's consent. You represent that you can form a binding contract with us.

3. Accounts, access, deletion

• You may need an account (email sign-in). Keep your credentials confidential.
• You're responsible for all activity under your account.
• Account deletion: you can request deletion by emailing support@hibi.space. We may take reasonable steps to verify the request and your identity.

4. Not advice; emergencies

The Service is informational and recreational only. It is not medical, mental-health, legal, financial, or other professional advice; it may be inaccurate or incomplete. Do not rely on it for decisions where harm could occur. Do not use the Service for emergencies. If you believe someone is at risk or in danger, contact your local emergency services.

5. Your content; ownership & license

• You own your chat content and memories you create in the Service.
• You grant us a limited, non-exclusive, revocable, worldwide, royalty-free license to host, process, back up, display, and transmit your content only as needed to operate, maintain, protect, and improve the Service and comply with law.
• You can delete content via account deletion or in-app tools (where available). Residual copies may persist in backups for a limited time.

6. AI outputs

Where the Service generates content for you, you own those outputs as between you and us (subject to third-party rights and applicable law). Outputs may be imperfect, repetitive, or unsafe if used out of context; use discretion.

7. Data use, analytics, and privacy

• We may use aggregated and/or de-identified data to operate, analyze, and improve the Service.
• We do not train our own models on your content.
• The Service uses third parties to provide infrastructure and functionality (see §12).
• Our Privacy Policy (hibi.space/privacy) explains how we collect and use personal data and is incorporated by reference.

8. Acceptable Use

You agree not to: (a) break the law; (b) infringe IP or privacy rights; (c) harass, exploit, or promote self-harm; (d) attempt to scrape, reverse-engineer, harm, or overload the Service; (e) upload malware; (f) circumvent security; or (g) use outputs as authoritative medical/legal advice.

9. Subscriptions, payments, refunds (Apple IAP)

• Payments: All purchases and subscriptions are via Apple In-App Purchase. Prices may vary by region/taxes; the current price is shown in-app (e.g., Premium monthly and yearly plans).
• Auto-renewal: Subscriptions auto-renew unless canceled in iOS Settings > [Your Name] > Subscriptions before the renewal date.
• No free trial and no intro promotions at this time.
• Refunds: Handled under Apple's policies. We generally do not offer additional refunds.
• Price changes: If we change pricing, we'll follow Apple's procedures and show notices in-app and/or via Apple's standard flows.

10. Changes to the Service

We may add, change, or discontinue features at any time. If we discontinue the Service, we'll provide reasonable notice when feasible.

11. Termination & suspension

We may suspend or terminate your access if: (a) you breach these Terms or our AUP; (b) there's suspected fraud, abuse, or harm risk; (c) we're required to by law.

Upon termination, your access ends; we'll provide a 30-day window to request an export of your content where feasible, unless prohibited by law or safety concerns.

12. Third-party services

We use third-party providers including OpenAI, Vercel, Neon Postgres, Chroma, Ably, OneSignal, PostHog, and Inngest to run the Service. We're not responsible for third-party outages or terms. We currently do not offer "export/share to third-party" features from within the app.

You will defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content or your breach of these Terms, to the extent permitted by law.

16. App Store terms; Apple EULA

If you obtained the app via Apple's App Store, you also agree to Apple's Standard Licensed Application End User License Agreement (EULA) and Apple Media Services terms. Apple is not responsible for providing maintenance or support for the app. Manage/cancel subscriptions in your device's Settings as described above.

17. Governing law & venue

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of France. Exclusive jurisdiction and venue: the courts of Paris, France.

18. Changes to these Terms

We may update these Terms from time to time. For material changes, we will provide at least 7 days' advance notice (e.g., in-app). The "Effective Date" above will reflect the latest version. If you continue using the Service after the changes take effect, you accept the updated Terms.

19. Miscellaneous

• Entire agreement: these Terms + Privacy Policy.
• Severability: if any part is unenforceable, the rest remains in effect.
• Assignment: you may not assign these Terms without our consent; we may assign as part of a merger, acquisition, or sale of assets.
• No waiver: failure to enforce is not a waiver.
• Language: the controlling language of these Terms is English.
